This Privacy Policy explains how MiTAC Digital Technology Corporation and its affiliates (collectively, “Mio” “We,” “Us” or “Our”) may collect, use, process, disclose, view, store, transfer and/or safeguard information We obtain through the Product, the Software and/or the Service, etc. It also tells you, an individual end-user of the Product (“You” or “Your”), about your rights and choices with respect to Your personal data, and how You can contact Us if You have any questions or concerns.
All other terms not defined in this Privacy Policy will have the meanings set forth in the End User License Agreement and Terms of Use (“EULA”).
PURPOSE AND BASIS OF MIO’S COLLECTION AND PROCESSING OF YOUR PERSONAL DATA
Where applicable, Mio indicates whether and why You must provide Us with Your personal data, as well as the consequences of failing to do so. If You do not provide personal data when requested, You may not be able to benefit from our Service if that information is necessary to provide You with the Service or if We are legally required to collect it.
When used in this Privacy Policy, “personal data” may include photos, video, film or pictures.
Agreement with You
We collect and process Your personal data for purpose of performing Our obligations under the EULA.
We use the personal data collected from You for purpose of delivering the service to You, rendering of maintenance services, and, upon Your consent, providing You with updated news and marketing information on the products and services offered by Mio.
Customer Support or Communication
When You interact with Our customer support via email, telephone, online or in person, We collect Your personal data, such as name, address, phone number, email address and contact preferences, information about the Products You own, such as their serial numbers and dates of purchase. To improve customer service, subject to applicable laws, We may also record and review conversations with customer support, and analyze any feedback provided to Us through voluntary customer surveys. With Your consent, Our customer support may utilize Your personal data, if appropriate, to help troubleshoot and resolve Your issue.
We also use Your personal data to respond to You when You contact Us.

SHARING OF YOUR PERSONAL INFORMATION
Mio is required to disclose certain personal data collected from You to third parties e.g. logistic service provider(s), maintenance service provider(s), email delivery service provider(s), marketing service provider(s) and cloud service provider(s) We have chosen to support Us for carrying out the purposes stated above.
From time to time, We share activity data in a de-identified and aggregated manner with or to companies that provide Mio and Our customers with content or features for the purpose of enhancing the quality of the content or features they provide, and with or to other third parties for research or other purposes.
We may disclose personal data about You to others: (a) if We have Your valid consent to do so; (b) to comply with a valid subpoena, legal order, court order, legal process, or other legal obligation; (c) to enforce any of Our terms and conditions or policies; or (d) as necessary to pursue available legal remedies or defend legal claims.
We may also transfer Your personal data to an affiliate, a subsidiary or a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of Mio’s business, assets or stock, including, without limitation, in connection with any bankruptcy or similar proceeding, provided that any such entity that We transfer personal data to will not be permitted to process Your personal data other than as described in this Privacy Policy without providing You notice and, if required by applicable laws, obtaining Your consent.

This Privacy Policy applies only to the processing of Your personal data by Mio. The Service may contain links to third party sites, such as third party content providers (“Third Party Sites”). The policies and procedures described in this Privacy Policy do not apply to Third Party Sites. The links from the Service to any Third Party Sites do not imply that We endorse or have reviewed the Third Party Sites, for which You will be solely responsible.
PERSONAL DATA TRANSFER
If You are using the Service from regions with laws governing data collection and use, then please note that You are agreeing to the transfer of Your personal data to Taiwan and processing globally. By providing Your personal data to the Service, You consent to any transfer and processing in accordance with this Policy.
YOUR RIGHTS
Right to withdraw consent. Where Mio is collecting or/and processing data based on Your consent, You have the right to withdraw that consent at any time.
In addition, You have the right to:
access Your personal data;
copy or transfer Your personal data;
demand rectification of incorrect or incomplete data;
require deletion or removal of Your personal data;
request not to be subject to entirely automatic profiling algorithms;
impose restriction on processing of Your personal data; and object to the processing of Your personal data based on grounds other than Your express consent.
We may use automated processing with Your personal data to allow Us to provide You with service and product information that is most suited for Your interests. If You are unhappy with the automated decision, You can contact Us and request a manual review.
You have the right to lodge a complaint with the competent authority in Your country of residence should You believe that Mio has violated Your privacy right through inappropriate use of Your personal data and has failed to promptly cure such violation upon receipt of Your request for cure.
We will apply Your preferences going forward and this will not affect the lawfulness of the processing before Your consent withdrawal.

CHILDREN'S PRIVACY
We do not knowingly collect, maintain, or use personal data from children under the legal age, and no part of the Service is directed to children under the legal age, such as the age of 18 in Taiwan. We encourages parents and guardians to take an active role in their children's online activities. We do not knowingly collect personal information from children without appropriate parental or guardian consent. When determining the retention period, We take into account various criteria, such as the type of Service requested by or provided to You, the nature and length of Our relationship with You, the impact on the Services We provide to You if We delete some information from or about You and mandatory retention periods provided by law and the statute of limitations.
